[BlueOnyx:14487] Mistake with cced restart?

Hello,

I see a strange behavior on one machine.
cced is running. 

18027 ?        Ss     0:00 /usr/sausalito/sbin/cced

I do a 

/etc/init.d/cced.init restart

Now /usr/sausalito/sbin/cced is gone but I also see the two processes:

18695 pts/1    S+     0:00 /bin/sh /etc/init.d/cced.init restart
18698 pts/1    S+     0:00 /bin/sh /etc/init.d/cced.init stop

It seems that /bin/sh /etc/init.d/cced.init stop is not understanding that cced is already stoped.
If I kill "/bin/sh /etc/init.d/cced.init stop" manually then start is starting and is starting the service.

Is this a result of missing updates ot is it a general bug?
