Chris found the cat
[root at host ~]# cat /etc/clamav-milter.conf | grep ClamdSocket
ClamdSocket unix:/var/run/clamav/clamd.sock

That looks better ;)

So both conf files are pointing to the same socket BUT
still have the errors in logwatch
